Robyn Fox and Brian Plegge prevail in an appeal before the Eighth Circuit. In Viasystems, Inc. v. EBM-Papst St. Georgen GmbH & Co., KG, the U.S. Court of Appeals for the Eighth Circuit affirmed a district court's dismissal of a lawsuit against a German manufacturer. The Eighth Circuit held that the district court did not err in finding it lacked personal jurisdiction over the defendant. The appellate court found that the German company's incidental contacts with Missouri do not constitute a deliberate and substantial connection with Missouri such that the company could reasonably anticipate being haled into court in Missouri. The appellate court found that there was no basis for general or specific personal jurisdiction over the company. The appellate court also found that the district court did not err in denying plaintiff's request for jurisdictional discovery.
